1. Introduction
These Terms and Conditions ("Terms") govern the provision of services by Grannexe ("we", "our", "us") to our customers ("you", "your"). By engaging our services, you agree to be bound by these Terms.
Grannexe is registered in England and Wales. Company registration number: 05809202. Our registered office is located at Rear of 158 Main Road, Biggin Hill, Kent, TN16 3BA.
2. Services
Grannexe specializes in the design, manufacture, and installation of bespoke granny annexes. Our services include:
- Initial consultation and site survey
- Design and specification of annexe
- Assistance with planning permission (where required)
- Manufacture of annexe components
- Installation and completion of annexe
- Post-installation support and warranty services
3. Quotations and Pricing
3.1 Quotations
All quotations provided are valid for 30 days from the date of issue unless otherwise stated. Quotations are based on the information provided by you and site conditions as observed during our initial survey.
3.2 Pricing
Our pricing includes:
- Design and specification
- Manufacturing of annexe components
- Delivery and installation
- Standard finishes and fixtures as specified
Pricing does not include (unless otherwise stated):
- Site preparation and groundworks
- Utility connections (electricity, water, drainage)
- Planning permission fees
- Building control fees
- Any upgrades or variations from the standard specification
3.3 VAT
Our annexes may qualify for zero VAT under the Caravan Act when constructed as mobile homes. VAT status will be confirmed in your quotation based on your specific requirements.
4. Deposits and Payments
4.1 Deposit
A deposit of 25% of the total contract value is required upon signing the contract to secure your project and commence design work.
4.2 Stage Payments
The remaining balance is typically paid in the following stages:
- 25% upon approval of final designs and before manufacture commences
- 25% upon delivery to site
- 25% upon practical completion
Specific payment schedules will be detailed in your contract.
4.3 Late Payment
Payment is due within 7 days of invoice date unless otherwise agreed. Late payments may incur interest charges and may delay project progress.
5. Planning Permission and Building Regulations
5.1 Your Responsibility
You are responsible for obtaining any necessary planning permission and building regulation approval. We can provide guidance and assistance, but ultimate responsibility lies with you as the property owner.
5.2 Caravan Act Route
Where applicable, we can construct your annexe to comply with the Caravan Act, which may not require planning permission. This will be discussed during consultation.
5.3 Delays Due to Planning
Any delays caused by planning or building control processes are outside our control and will not affect the validity of your quotation or contract.
6. Site Preparation
6.1 Customer Obligations
Before installation, you must ensure:
- A suitable base or foundation is prepared according to our specifications
- Clear and safe access to the installation site for delivery vehicles and equipment
- All necessary utility connection points are available
- Any required site clearance or preparation work is completed
6.2 Additional Costs
If site conditions differ from those observed during the initial survey, additional costs may be incurred. We will notify you of any such costs before proceeding.
7. Installation and Timescales
7.1 Installation Period
Typical installation takes 10-20 working days, depending on the size and complexity of the annexe. A detailed installation schedule will be provided before work commences.
7.2 Delays
We will make every effort to complete your project on schedule. However, delays caused by adverse weather, site conditions, planning issues, or circumstances beyond our control will not make us liable for any losses or additional costs you may incur.
7.3 Access Requirements
You must provide reasonable access to the site during installation. We will notify you in advance of all scheduled work.
8. Warranty and Guarantees
8.1 10-Year Structural Guarantee
We provide a 10-year guarantee on the structural integrity of your annexe, covering defects in materials and workmanship under normal use.
8.2 Exclusions
The warranty does not cover:
- Normal wear and tear
- Damage caused by misuse, neglect, or unauthorized modifications
- Damage from extreme weather events or acts of nature
- Third-party products and appliances (which have their own manufacturer warranties)
- Issues arising from inadequate maintenance
8.3 Claims
To make a warranty claim, notify us in writing within 7 days of discovering the defect. We will arrange an inspection and, if the claim is valid, carry out repairs at no cost to you.
9. Variations and Changes
9.1 Requesting Changes
Any variations or changes to the specification after contract signing must be requested in writing and will be subject to a revised quotation.
9.2 Additional Costs
Changes made after manufacture has commenced may incur significant additional costs and delays. We will provide a clear breakdown before proceeding.
10. Cancellation and Termination
10.1 Your Right to Cancel
You have a 14-day cooling-off period from the date of signing the contract during which you may cancel for a full refund of your deposit, provided no work has commenced.
10.2 Cancellation After Work Commences
If you cancel after the cooling-off period or once work has commenced, you will be liable for all costs incurred up to the point of cancellation, plus a reasonable administration fee.
10.3 Termination by Grannexe
We reserve the right to terminate the contract if you fail to make payments when due or breach these Terms. In such cases, you remain liable for all costs incurred.
11. Limitation of Liability
11.1 Exclusions
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
11.2 Liability Cap
Subject to clause 11.1, our total liability to you under these Terms shall not exceed the total contract value paid by you.
11.3 Consequential Losses
We are not liable for any indirect or consequential losses, including loss of profits, loss of business, or loss of opportunity.
12. Insurance
We maintain appropriate public and employer's liability insurance. You are responsible for insuring your annexe and its contents once installation is complete.
13. Intellectual Property
All designs, plans, and specifications created by Grannexe remain our intellectual property. You may not reproduce or share these with third parties without our written consent.
14. Data Protection
We process your personal data in accordance with our Privacy Policy. By accepting these Terms, you consent to such processing.
15. Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, strikes, or government restrictions.
16. Dispute Resolution
16.1 Negotiation
In the event of a dispute, both parties agree to first attempt to resolve the matter through good faith negotiation.
16.2 Mediation
If negotiation fails, disputes may be referred to mediation before commencing legal proceedings.
17. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
18. Entire Agreement
These Terms, together with your signed contract and any written variations, constitute the entire agreement between you and Grannexe and supersede all prior agreements or understandings.
19. Amendments
We reserve the right to update these Terms from time to time. Any changes will be posted on our website and will apply to contracts entered into after the change date.
